Congressional Scrutiny Intensifies for Dr. Anthony Fauci Post-Retirement

Dr. Anthony Fauci, who retired from public service in 2022, has been the subject of a series of congressional hearings and investigations in recent months. These proceedings have focused on various aspects of the COVID-19 pandemic response and his previous roles.

On June 3, 2024, Dr. Fauci provided public testimony before the House Select Subcommittee on the Coronavirus Pandemic. During this hearing, he faced questions concerning the origin of COVID-19 and the former recommendation of “six feet social distancing.” Fauci admitted that the guidance for “six feet social distancing” “just sort of appeared” and was a decision made by the CDC that was not based on concrete scientific studies. He also stated that the lab-leak hypothesis, which posits the virus originated from a laboratory, should not be dismissed as a conspiracy theory.

Congressional scrutiny escalated further on July 29, 2026, during a Senate hearing with Senator Rand Paul. On this occasion, Dr. Fauci invoked his Fifth Amendment rights over 100 times, refusing to answer questions about COVID-19’s origin and accusations of misleading Congress. Republicans subsequently accused Dr. Fauci of lying in previous testimonies, while Democrats characterized the hearing as politically motivated and defended his efforts during the pandemic.

Following this, on August 6, 2026, the Senate Committee on Homeland Security and Governmental Affairs voted to hold Dr. Fauci in contempt of Congress due to his refusal to testify. The case has since been forwarded to the Department of Justice for further action. Prior to his departure in January 2025, former President Joe Biden had issued a preemptive pardon to Dr. Fauci. Republicans suggested this pardon was intended to weaken Fauci’s ability to invoke the Fifth Amendment. However, Dr. Fauci’s lawyers advised him to use the Fifth Amendment, citing Senator Paul’s “obsession with prosecuting” Fauci.

Further developments in May 2024 revealed that David Morens, a senior scientific advisor to Fauci, allegedly utilized private emails to bypass Freedom of Information Act (FOIA) requests and shared confidential information with Dr. Peter Daszak of EcoHealth Alliance. Additionally, Senator Rand Paul has publicly released private diary entries and text messages from Fauci, which, according to Paul, indicate discrepancies between Fauci’s public statements and his private doubts during the pandemic.
